Vermont's financial privacy law generally bars financial institutions from disclosing a customer's financial information to anyone, subject to a list of exceptions such as customer authorization, legal process and routine business exchanges. It also regulates loan lead solicitations that use a financial institution's name or a consumer's loan details.

Penalties
In addition to general enforcement powers under 8 V.S.A. §§ 11601-11603, the Commissioner may impose administrative penalties of up to $1,000 per violation resulting from willful conduct or from failing to maintain compliance procedures (§ 10205).

  • Persons sending loan lead solicitations to Vermont consumers (§ 10206)

What a privacy notice must say

  • Solicitations that include a consumer's loan number, amount or other specific loan information must state that the sender is not affiliated with or authorized by the lender, among other disclosures.8 V.S.A. § 10206(c)

Practices it requires

  • Do not disclose any customer financial information to any person except as the subchapter expressly allows.8 V.S.A. § 10203
  • Customer-authorized disclosures must be limited to the scope and purpose the customer authorizes.8 V.S.A. § 10204(2)

  • Adopt reasonable procedures to ensure compliance with the financial privacy subchapter.8 V.S.A. § 10203
